Definitions

  • Site: e-commerce website accessible from PCR Bookshop which offers the Products for sale.
  • Buyer: adult consumer purchasing one or more products for his or her personal needs through the website.
  • User: any person using the site PCR Bookshop or one of the services available on the Site.
  • Product: item offered for sale on the website.
  • EUROPA GROUP: SAS, 19 Allées Jean Jaurès – 31000 TOULOUSE entity offering the Products for sale through the Site, which it operates, as identified below.
  • Order: Buyer’s order to buy one or more products through the Site.
  • Party(ies): Buyer and/or EUROPA GROUP

These general terms and conditions of sale (hereafter the "Terms of Sale") are entered into by EUROPA GROUP (hereafter the "Seller", "we" or "us"), which manages the Site, and any individual or business wishing to make a purchase through the website PCR Bookshop hereafter "you" or the "Buyer".

Object

These Terms of Sale govern the contractual relationship between Europa and the Buyer, and any purchase made through the Site.

By purchasing a product through the Site, the Buyer unreservedly accepts these Terms of Sale.

When placing an order, the Buyer must tick box I accept the general terms and conditions of sale and acknowledge having read the policy of management of personal data to confirm the order. By ticking the box, the Buyer acknowledges having read the Terms of Sale and unreservedly accepts them in full.

The Seller reserves the right to update these Terms of Sale from time to time, in order to comply with any new regulations or to improve the use of the Site. The applicable conditions will therefore be those in force on the date the Buyer places the order.

Creating a customer account

Before you can place an order, you must first create a “customer account” at the site PCRonline. To create an account, you will need to provide personal information such as your first and last names, date of birth, place of work, country and interests (fields that must be completed are marked with an *).

You undertake to provide accurate information. You are solely responsible for the accuracy and relevance of the information you provide to the Seller. You are responsible for ensuring that your information is current. You must therefore inform us of changes to your information as soon as possible.

If you wish to place an order or consult your account (order status, history, etc.), you must give your identifiers (email address and password you specified when registering).

You may consult your orders placed through the Site at any time by logging into your customer account.

EUROPA GROUP reserve the right to delete the customer account of any Buyer that fails to fulfil its commitments as set out in these Terms of Sale.

In such case, you have no claim to compensation. In addition, if warranted by the facts, we will be able to take legal proceedings against you.

Accessibility of the service

Any User can access the Website free of charge.

Users can access the Site's services 7 days a week, 24 hours a day throughout the year, unless services are interrupted for maintenance or for any other reason that is out of Europa's control, including interruption of the Internet or the IT and network infrastructures on which the Site depends, or force majeure.

As EUROPA GROUP is, by virtue of its activity, bound by an obligation of means, it may not be held liable for any loss whatsoever resulting from the unavailability of the Site.

Product Description

EUROPA GROUP fulfils its duty to provide pre-contractual advice and information under Article L121-18 of the Consumer Code and the articles to which it refers.

EUROPA GROUP undertakes to describe the main features of the products on its e-commerce site in order to comply with the provisions of Article L.111-1 of the Consumer Code.

The products governed by these General Terms and Conditions are those shown on the Website as being sold and shipped by Europa. They are available for purchase within the availability of stocks for the products shown.

The main features of the Products are described and presented as accurately as possible in the product descriptions on the Site.

Price of products available on the Site

The prices are shown in euros exclusive of tax, duties and delivery costs, which are borne by the Buyer unless otherwise specified.

Tax and duties apply when you confirm the order; they are based on your country of origin and are applicable on the day of the Order.

We reserve the right to modify the prices of the Products shown on the Site. In any event, you will be invoiced for the Products based on the prices in force when you confirm the Order.
When creating your account, you must specify your status (REGULAR or SPECIAL RATE), providing supporting documents as proof. Your status determines the price of certain Products.

Orders

Placing an Order

Orders are placed in English and in euros.

You may place any Order directly on the Site; your Order entails an obligation to pay.

For any order, you will bear the telecommunications cost when accessing the Internet and browsing the Site.

All necessary steps to place an Order are shown on the Site.

When placing an Order, you agree to provide true and correct information.

Pursuant to Article 1369-2 of the French Civil Code, before confirming an Order, you may go back to the previous pages and correct and modify your Order and/or the information you gave.

We will not be liable for any errors you make when placing an Order, nor for any subsequent late or incorrect delivery because of such errors. In any event, the costs incurred in connection with any re-shipment shall be at your expense.

Confirming your Order

You confirm your Order in accordance with the French Consumer Code according to the 'double click' process.

The 'double click' process consists of:

  • a first click to place the product in your basket;
  • a second click to confirm your basket after checking the contents of the Order.

Once you have confirmed an Order, an email acknowledging receipt of the Order and containing all this information will then be sent as soon as possible.

Any Order you confirm by the 'double click' process (double confirmation) constitutes an express and irrevocable acceptance of the prices and descriptions of the products available for sale.

When confirming your basket, you must also fully accept these general terms and conditions of sale.

We reserve the right to suspend or cancel any Order, regardless of its nature and stage of execution, in the event of non-payment or partial payment of any sum due by you, payment incident, fraud or attempted fraud relating to the use of the Site, including in connection with previous Orders.

Payment

All Orders are payable in euros. Purchases are paid either directly online by credit card or subsequently by bank tranfer to Europa Group:

You will be charged the full amount shown in the Order summary on the day of your Order.

You warrant to EUROPA GROUP that you are fully authorised to use the payment method chosen for your Order and that this payment method legally provides access to sufficient funds to cover all costs resulting from your Order placed on the Site.

We cannot be held liable for any fraudulent use of the payment method used.

We reserve the right to suspend or cancel any Order and/or delivery, regardless of its nature and stage of execution, in the event of non-payment of any sum due by you, or payment incident.

Secure payment

Data you provide when paying by bank card is processed securely. 

We have no access to your bank details and do not keep them on our servers: for this reason, these details are systematically requested whenever a new transaction is made on the Website.

Default in payment

We reserve the right to refuse to honour an Order from a Buyer that has failed to pay for a previous order in full or in part, or with which a payment dispute is ongoing.

We retain full ownership of the products sold until the Customer's payment is deemed final, i.e. after we have effectively collected the amounts due.

Right to cancel

In accordance with the applicable texts of the French Consumer Code and in connection with distance selling, you have a cancellation period of fourteen (14) clear days from the day following receipt of your order.

You must notify us of your decision to cancel your order by sending an email to [email protected] 

Your intention to exercise your right to cancel must be unambiguous.

You do not have to give any reason for exercising your right to cancel, and you will not incur any penalty because of exercising this right.

Proof of the effective exercise of the right to cancel rests with you.

You must return the product(s), in their original packaging (in an unopened blister pack), without excessive delay and no later than fourteen (14) working days after communication of your decision to cancel.

If you return the product(s) within this period, you are entitled to reimbursement of the ordered Product price and delivery costs, based on the cost of a standard delivery, regardless of the delivery method you selected when placing the Order.

The cost of return shall be borne by you.

You will be refunded the price invoiced by bank transfer, including the delivery costs, within thirty (30) working days of receipt of the returned product(s).

Limits to the right to cancel

Under no circumstances may your exercising the right to cancel be abusive.

Pursuant to Article L 121-21-8(1) of the French Consumer Code, you expressly waive your right to cancel dematerialised services, since such services will have been executed in full before the end of the said period.

Liability - force majeure

We shall not be liable in the event that the contract is not performed or not performed properly if such failure is attributable either to you, notably due to the misuse of the ordered products, or to a third party to the contract, or because of a case of force majeure.

We shall not be held liable for any non-performance or late performance of any of our obligations under these General Terms and Conditions of Sale caused by events beyond our will and control (case of force majeure).

A case of force majeure means any act, event, non-event, omission or accident beyond our will and control.

For as long as they last, such cases of force majeure will suspend our obligations mentioned in these general terms and conditions of sale.

Similarly, we may not be held liable for any inconvenience, damage or loss inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.

Legal warranties

All Products on sale on the Site are covered by a legal warranty of compliance (L.211-1 et seq. of the French Consumer Code) and a warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), allowing the Buyer to return the defective or non-compliant delivered Products.

Proof

In any event, the online provision of the bank card number and the final confirmation of the Order shall constitute proof of the entire order in accordance with Article 1316-1 of the Civil Code and will cause the sums incurred for the order of the Products shown on the purchase order to become due and payable.

This confirmation constitutes the signature and express acceptance of all transactions undertaken on the Site. Electronic records stored on our IT systems under reasonable security conditions shall be deemed as proof of communications, Orders and payments made between the parties.

This data is archived on a reliable and durable medium in order to provide a true and lasting copy in accordance with Article 1348 of the Civil Code.

Intellectual property

All elements published on the Site, such as sound, images, photographs, videos, texts, animations, programmes, graphic charter, database tools, software and other underlying technology are protected by the provisions of the Intellectual Property Code and belong to EUROPA GROUP.

Any total or partial reproduction, modification, imitation or use of these illustrations, images, logos or videos for any reason and on any medium whatsoever, without our express prior agreement, is strictly prohibited.

The distribution, resale, copy, library loan, transfer, exchange or any free or paid distribution of the products marketed on the Site (in whole or in part) is strictly PROHIBITED, regardless of the medium (electronic or printed).

For any specific use of the Products ordered on the Site, you are invited to submit a request by e-mail at [email protected].

For any additional printing and for non-commercial purposes, you should submit a prior request by e-mail at [email protected].

Amendments

We reserve the right to amend these Terms of Sale from time to time. In this case, the applicable conditions shall be those in force on the date you place an Order.

Entire agreement

If any of these Terms of Sale are found to be invalid pursuant to a law, regulation or final court decision, the rest of the provisions shall remain in full force and effect.

Applicable law and jurisdiction

These Terms of Sale are governed by French law.

Any dispute that may arise from the interpretation or performance of these Terms of Sale and subsequent amendments shall be subject to the exclusive jurisdiction of the competent courts.
